Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of sportsperformancehub.com and related services (the "Site"), operated by VSGS Facilities, LLC d/b/a Sports Performance Hub ("SPH," "we," "us," or "our"). It supplements and is incorporated into our Terms of Use. Violating this AUP may result in suspension or termination of access and may expose you to civil and criminal liability.

1. General Conduct

You agree to use the Site lawfully, respectfully, and only for its intended purposes. You will comply with all applicable laws and with our Terms of Use, Privacy Policy, and this AUP.

2. Prohibited Conduct

You will not, and will not permit any third party to:

• (a) violate any law, regulation, or third-party right;
• (b) access, use, or attempt to access any non-public area of the Site, other users' accounts, or our systems without authorization;
• (c) probe, scan, or test the vulnerability of the Site, or breach or circumvent any security or authentication measure;
• (d) introduce viruses, malware, or other harmful code, or interfere with or disrupt the Site's integrity, availability, or performance (including denial-of-service activity);
• (e) impersonate any person or entity or misrepresent your affiliation; or
• (f) engage in fraudulent, deceptive, harassing, threatening, defamatory, obscene, or otherwise objectionable conduct.

3. No Scraping; No Automated Collection

You will not use any robot, spider, scraper, crawler, or other automated means to access, monitor, index, harvest, or copy any part of the Site or its content, or to collect information about other users, without our prior written consent. You will not aggregate, republish, or create derivative databases from Site content.

4. No AI Training or Ingestion

Consistent with SPH's confidentiality and data-protection commitments, you will not use the Site, its content, or any data obtained through it to train, fine-tune, validate, benchmark, ground, or otherwise develop or improve any artificial-intelligence, machine-learning, large-language-model, or generative-AI system, or input any such content or data into any tool or service that trains on, retains, or learns from inputs, in each case without SPH's prior written consent. This restriction is in addition to any obligations under a separate non-disclosure or other agreement with SPH.

5. Intellectual Property; No Reverse Engineering

The Site and its content, together with the "Sports Performance Hub" and "SPH" names, marks, logos, program designs, and methodologies, are owned by SPH or its licensors. You will not copy, distribute, modify, publicly display, or create derivative works from Site content except as expressly permitted, and you will not reverse engineer, decompile, or disassemble any software or technology made available through the Site.

6. Confidential, Proprietary, and Investor Information

You will not use, disclose, or misappropriate any confidential or proprietary SPH information, business plans, financial or investor information, athlete or performance data, or trade secrets that you may access through or in connection with the Site. Any such information is protected under applicable law and, where shared with you, under a separate non-disclosure agreement, which controls. Nothing on the Site is an offer of securities or an investment solicitation (see Disclaimer).

7. Health, Biometric, and Other Sensitive Data

You will not collect, attempt to collect, misuse, or disclose any other person's health, biometric, or performance data, or any personal information of any individual, obtained through the Site. Biometric and health information is collected by SPH only under the consents and protections described in our Privacy Policy and applicable consent forms; you will not circumvent, misuse, or interfere with those processes.

8. Protection of Minors

Sports Performance Hub serves youth athletes, and minors may access the Site under the involvement, supervision, and consent of a parent or legal guardian, who must create any account and make any purchase on a minor's behalf. You will not attempt to collect, solicit, or misuse any personal information of a minor, and you will not use the Site to contact, target, or endanger any minor. We do not knowingly collect personal information from children under 13 without verifiable parental consent, and any activity involving minors must comply with our Privacy Policy and applicable law, including COPPA.

9. User Content Standards

If you submit content through the Site, you are responsible for it and represent that it does not violate this AUP, any law, or any third-party right. We may remove content and suspend access at our discretion.

10. Reporting Violations

Report suspected violations, security issues, or misuse to info@sportsperformancehub.com. We may investigate and cooperate with law enforcement, and we reserve all rights and remedies, including injunctive relief.

11. Enforcement; Changes

We may suspend or terminate access for any violation, with or without notice. We may update this AUP at any time by posting the revised version with a new "Last Updated" date; continued use constitutes acceptance.
