Privacy Policy

VSGS Facilities, LLC d/b/a Sports Performance Hub ("SPH," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information in connection with the website sportsperformancehub.com and related online and offline services (collectively, the "Services"), and describes your rights and choices. By using the Services, you agree to this Policy.

1. Scope

This Policy applies to personal information we process about website visitors, athletes and participants, parents/guardians, prospective and current members, event attendees, and business contacts. Separate or supplemental notices (including our Biometric Data Notice, program registration forms, and waivers) may apply to specific activities and control if there is a conflict as to the activity they cover.

2. Information We Collect

• (a) Information you provide: name, email, phone number, mailing address, date of birth/age, account credentials, emergency contact, parent/guardian information (for minors), program and membership selections, payment information (processed by our payment providers), communications, and content you submit through forms.
• (b) Athletic, performance, and health-related information: training, performance, assessment, and fitness data; and, where you choose to provide it, health, injury, or medical information relevant to participation. We treat this as sensitive information.
• (c) Biometric information: in connection with 3D body-scanning and performance-capture technology, we and our technology partners may collect biometric identifiers and biometric information such as body measurements, scans, and derived metrics. We collect and use biometric information only with your (or a parent/guardian's) separate, informed, written consent as described in our Biometric Data Notice (Section 9).
• (d) Information collected automatically: IP address, device and browser type, operating system, pages viewed, referring/exit pages, and usage data, collected via cookies and similar technologies (see Section 7).
• (e) Information from third parties: payment processors, scheduling and analytics providers, social media, event partners, and referrals.

3. How We Use Information

We use personal information to: (a) provide, operate, and improve the Services; (b) register and manage accounts, memberships, programs, and events; (c) process payments; (d) deliver athletic assessments and performance services; (e) communicate with you (including service messages and, with consent where required, marketing and SMS per our SMS Policy); (f) personalize content; (g) ensure safety and security and prevent fraud; (h) comply with legal obligations; and (i) establish, exercise, or defend legal claims. We do not use your Confidential or sensitive information to train third-party artificial-intelligence systems except as permitted under enforceable no-training/no-retention terms.

4. How We Disclose Information

We disclose personal information to: (a) service providers/processors (hosting, payment, scheduling, analytics, communications, body-scanning/performance technology) bound to protect it; (b) event, program, and educational partners as needed to deliver a service you request; (c) professional advisors (legal, accounting, insurance); (d) authorities where required by law or to protect rights and safety; and (e) a successor in a merger, acquisition, or asset sale. We also use analytics and advertising technologies provided by third parties — including Google, Meta (Facebook and Instagram), and TikTok — that collect information about your device and your activity on the Site through cookies and similar identifiers to help us measure and deliver advertising. Under the California CCPA/CPRA, the Florida Digital Bill of Rights, and similar state laws, our use of these technologies may be treated as a "sale" of personal information or as "sharing," "targeted advertising," or "cross-context behavioral advertising." We do not exchange your personal information for money, but we do use it for these advertising purposes, and you can opt out — see Section 11 (Your Privacy Rights) and our Cookie Policy. We do not use these advertising technologies for, and do not permit targeted advertising to, any user we know to be a child under 13 (see Section 5).

5. Children's and Students' Privacy

Sports Performance Hub offers youth athletic programs, and we know that children and teenagers visit the Site. We take particular care with their information and design the Site so that a parent or legal guardian creates any account, makes any purchase, and provides any required consent for a minor. This Section, together with our Biometric Data Notice and program consent forms, governs how we handle minors' information.

• Children under 13 (COPPA). The Site is not directed to children under 13 for the collection of personal information, and we do not knowingly collect personal information online from a child under 13 without verifiable parental consent as required by the Children's Online Privacy Protection Act (COPPA). We do not condition a child's participation on providing more information than is reasonably necessary, we do not use a child's information for targeted or behavioral advertising, and we do not knowingly permit our advertising partners to collect a child's information or build profiles of a child through the Site. If we learn we have collected a child's information without the required consent, we will delete it promptly.
• Minors aged 13 to 17. A parent or legal guardian must register, purchase, and consent on a minor's behalf. We use a minor's information solely to provide the requested programs and to protect participant safety; we do not sell it and do not use it for targeted advertising.
• Users in the EU/EEA and the UK. Where the EU General Data Protection Regulation (GDPR) or the UK GDPR applies, we do not process the personal data of a child below the applicable age of digital consent (16, or a lower age between 13 and 16 as set by the relevant country) in reliance on consent without authorization from the holder of parental responsibility, and we do not use children's data for profiling or targeted advertising.
• Parental rights. A parent or guardian may review the personal information we hold about their child, request that we correct or delete it, and refuse to permit further collection or use, by contacting us at privacy@sportsperformancehub.com. We will verify the request before acting on it.
• Student records. Where SPH handles student educational records in partnership with a school, we do so consistent with the Family Educational Rights and Privacy Act (FERPA) and applicable state student-privacy laws, under our agreement with the institution.

6. Sensitive and Biometric Information — Your Consent

We collect health/performance and biometric information only as needed for the Services and, where required by law, with your affirmative consent (or a parent/guardian's for a minor). You may withdraw consent at any time, subject to our need to retain records as required by law; withdrawal may limit our ability to provide certain Services. See the Biometric Data Notice (Section 9).

7. Cookies and Tracking

We use cookies, pixels, and similar technologies to operate the Site, remember preferences, analyze usage, and (where applicable) support marketing. You can control cookies through your browser settings and, where offered, our cookie banner/preference tool. We honor recognized opt-out preference signals (e.g., Global Privacy Control) where required by law. See our Cookie Policy for details.

8. Data Retention

We retain personal information for as long as needed to provide the Services, maintain records, resolve disputes, and comply with legal, tax, insurance, and safety obligations, after which we delete or de-identify it. Biometric information is retained and destroyed as stated in the Biometric Data Notice.

9. Biometric Data Notice (Summary)

Consistent with biometric-privacy laws, when SPH or its technology partners collect biometric identifiers/information: (a) we provide notice and obtain written consent before collection; (b) we state the purpose and duration of collection, storage, and use; (c) we do not sell, lease, or profit from biometric information; (d) we disclose it only to those providing the requested service or as required by law; and (e) we store, transmit, and protect it using a reasonable standard of care and destroy it when the purpose is satisfied or within the period required by law, whichever occurs first. 10. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information. No system is perfectly secure, and we cannot guarantee absolute security. Notify us immediately of any suspected compromise at privacy@sportsperformancehub.com.

11. Your Privacy Rights

Depending on where you live, you may have rights to: access/know, correct, delete, obtain a portable copy, opt out of sale/share/targeted advertising and certain profiling, and limit the use of sensitive personal information; and to not be discriminated against for exercising these rights.

• Florida (Florida Digital Bill of Rights): eligible Florida residents may exercise the rights above where applicable.
• California (CCPA/CPRA): California residents have the rights above; the categories of information we collect, use, and disclose are described in Sections 2–4. Because we use advertising technologies, you may opt out of our "sale" and "sharing" of personal information for cross-context behavioral advertising, and limit our use of sensitive personal information, as described below.
• Other U.S. states: residents of states with comprehensive privacy laws may have comparable rights.
• How to opt out of targeted advertising, "sale," and "sharing." You can opt out of our use of advertising technologies by (a) using the cookie-preference tool on the Site; (b) enabling a recognized opt-out preference signal such as Global Privacy Control (GPC), which we honor as a valid opt-out for the browser or device that sends it; and (c) using our "Do Not Sell or Share My Personal Information" and "Limit the Use of My Sensitive Personal Information" options where offered, or by emailing privacy@sportsperformancehub.com. Opt-outs are specific to the browser or device and may need to be renewed if you clear cookies.

To exercise rights, contact privacy@sportsperformancehub.com or 786-232-8599. We will verify your request and respond within the time required by law. You may use an authorized agent. You may appeal a denial by replying to our response; if you have concerns, you may contact your state Attorney General.

12. Marketing and Communications Choices

You may opt out of marketing emails via the "unsubscribe" link and manage SMS per our SMS/Text Messaging Policy (reply STOP). Service/transactional messages are not promotional and may still be sent.

13. Third-Party Links

The Services may link to third-party sites and services we do not control. This Policy does not apply to them; review their privacy policies.

14. International Users

The Services are operated in the United States. If you access them from outside the U.S., you consent to processing your information in the U.S., which may have different data-protection laws than your jurisdiction.

15. Changes to This Policy

We may update this Policy from time to time. Material changes will be indicated by updating the "Last Updated" date and, where appropriate, by additional notice. Continued use after changes constitutes acceptance.
